Fourth Amendment Victory, and Now, The Death Of the Bill Of Rights.
68The Fourth Amendment Trumps Law Enforcement.
Despite how absolutely pathetic it really is for law enforcement to need a court to tell them that e mail is not public domain, there has still been a major victory for all citizens of the United States; as the Fourth Amendment, as decided by a Sixth Circuit Court of Appeals, is in violation by law enforcement when they prevail upon an Internet Service Provider to spy on you via e mails within an ISP's server. This is HUGE for the American people, and a great big kick in the balls for George W. Bush and Dick Cheney law enforcement and police state lovers everywhere. We've got a long, long way to go to reclaim privacy and decency here in the United States of America, but I, for one, and for once, am very, very pleased.
This Landmark decision, dated Tuesday, December 14, 2010; in the case of The U.S. vs. Warshak plainly states that a warrant must be obtained before Law Enforcement can seize an individual's private e - mails. The court found that all e - mail users have the same, and reasonable expectations of privacy that they have with their phone calls, and postal mail. Again, that any agency of Law Enforcement in the United States of America would need a court to tell them that is plainly sick. Perhaps reading comprehension and United States History, and especially a reading of the Bill of Rights, were things never covered in police academy. I'd presume that kicking in the doors of harmless marijuana users, and shooting their harmless dogs in front of their children, was covered more thoroughly; as we saw recently in Oakland, California. Of course the problem concerning law enforcement here in America actually following the laws that they so eagerly enforce when you or I are the subjects is an altogether different, and more difficult challenge; but at least we've got something going for us here.
Because it is and has always been so very obvious an infraction of the ideals and values as stated by the founding Fathers of the United States of America to violate any person's Fourth Amendment Rights in the manner that the Sixth Court of Appeals has ruled against in favor of the people. I do, hereby call for and believe that a criminal case and a warrant of arrest concerning each and every law enforcement officer in the United States of America who has been known to have violated such rights granted to all citizens in the Bill of Rights be issued, and that the officer's peace officer's license hereby be withheld from them as they sit in jail awaiting adjudication.

The Death Of The Fourth Amendment.
It's hard to pinpoint an exact date, but the buzz - the MURDER was surely in the air the day that Bill Clinton stated,
“We can't be so fixated on our desire to preserve the rights of ordinary Americans.”
Of course the Declaration of Independence, the United States Constitution, and the Bill Of Rights are the documents that ensure the rights of "ordinary Americans," the people who make America great, make America civilized, and a place to grow up, to learn, to live, to raise a family. It doesn't much matter if you believe the official story about what happened on September the Eleventh years ago, or if you are like me, and see that it was something contrived and carried out for the corporate profiteering that we see, and the enslavement of the masses that we are seeing more and more of today. What matters is that you see that without one part of the Bill of Rights, the rest of it tumbles upon itself like a house of cards, and without one part of it, none of it exists.
The Drug War? Despite the thousands of studies that show that legalization along with preventative education and treatment outperform the "drug war," - we've still got our "drug war" against the American people, and the world's highest incarceration rate.
This is the verdict: Light has come into the world, but men loved darkness instead of light because their deeds were evil.
It should have been obvious to all long ago that the war on drugs would be the end of us all. The neo conservative pseudoChristians, and their judgement, their hatred, their apostasy, and their hypocrisy have certainly allowed for the wolves in sheep's clothing to come in, and destroy what was once so great, America. The neoconservative right clamored and adored Bush as they pocketed their Clinton era earnings, and they applauded as we attacked the innocents of the charges of 9/11. They cheered and thought it good when Bush's Constitutional Swan Song, the "patriot act" was signed into law - but will they cheer as their apostasy comes to it's final fruition?

Nice job man, you knocked this one out of the park! I'd add Obama to the list too, he had a chance to nix the so called patriot act but chose not to. I still can't look at Al Franken and not laugh!! Peace!! Tom
Haaaaaaaaaaaaaaaaaaaaa
Good news, one of the cracks in the foundation of our government has a temporary fix. I hope it holds.
This is very interesting thank you for relaying this information
The Disgrace in America video was excellent. More people need to be proud of their rights and exercise them just like this gentleman did. Notice how the sheriff said that if he had nothing to hide that he should let her in? That is one of the MANY techniques law enforcement officers use to manipulate its citizens.
Even when the sheriff disagreed with the property owner, he should not have tried to use predatory techniques to get his way.
Be educated and be proud of your rights! You will be hard pressed to find a way to be more patriotic.
The real downfall of the 4th Amendment is the vague requirement for Probable Cause in getting a Search Warrant.
The basis and scope of pc for the Search Warrant has been stretched so far that it is no longer the gatekeeper it was intended to be by its creators.
It seems like each decade the stretch increases. Probable Cause needs to once again become the gate keeper to personal privacy.

Great hub. I hope this law stands the test of time. My favorite thing is when people actually think justice and criminal justice are the same thing. Not even related these days.
